These Terms of Service ("Terms") govern your access to and use of the founde.cc website and related services (the "Service"), operated by Founde LLC, a Delaware limited liability company with its registered office at 1201 N Market St, Ste 111, Wilmington, DE 19801, United States ("Founde", "we", "us"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old (or the minimum age required in your country to consent to the processing of personal data) to use the Service. By using the Service, you represent that you meet this requirement and that you are legally able to enter into a binding contract with us.

You are responsible for keeping your credentials confidential and for all activity that occurs under your account. You must provide accurate information and update it as needed. We may suspend or terminate accounts that violate these Terms.
3. User content
You retain ownership of content you submit to the Service ("User Content"). By posting User Content you grant Founde a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, publicly display and distribute that content for the purpose of operating, promoting and improving the Service. You represent that you have the necessary rights to grant this license and that your User Content does not infringe any third party rights or applicable law.
4. Acceptable use
You agree not to:
- violate any applicable law or regulation;
- infringe the intellectual property, privacy or other rights of others;
- post unlawful, harmful, harassing, defamatory or fraudulent content;
- attempt to gain unauthorised access to, disrupt, or reverse engineer the Service;
- use automated means to scrape or collect data without our prior written consent;
- impersonate any person or misrepresent your affiliation with any entity.
5. Intellectual property
The Service, including its software, design and branding, is owned by Founde LLC and its licensors and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.
6. DMCA / copyright complaints
If you believe content on the Service infringes your copyright, please send a notice compliant with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) to founde.cc@gmail.com, including: (a) identification of the copyrighted work; (b) the URL of the allegedly infringing material; (c) your contact information; (d) a statement of good-faith belief that the use is not authorised; (e) a statement, under penalty of perjury, that the information is accurate and you are authorised to act; (f) your physical or electronic signature.
7. Third-party services
The Service may link to or integrate with third-party services. We are not responsible for their content, terms or practices, and your use of them is governed by their own terms.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES ANY LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW (INCLUDING CONSUMER RIGHTS UNDER EU / EEA / UK LAW).
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUNDE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED USD 100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (e.g. intellectual property, disclaimers, limitation of liability, dispute resolution) will survive.
11. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Subject to any mandatory consumer protections available to you in your country of residence (including within the European Union / EEA), the state and federal courts located in Delaware, USA will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
12. Consumers in the European Union
If you are a consumer resident in the EU / EEA, you benefit from any mandatory provisions of the law of your country of residence. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged to and do not commit to participate in dispute resolution before a consumer arbitration board.
13. Changes to the Terms
We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
